Why we collect it

We never sell your personal information and we never store your card details. Sharing is limited to the partners needed to fulfil your order.

1.Who we are

Direct Art Australia sells hand-painted oil paintings, canvas prints and custom portraits online, made to order and delivered across Australia. When this policy says "we", "us" or "our", it means Direct Art Australia. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

2.What we collect

To use certain features of the site, we may require information that identifies you personally, which may include your name, company name, email address, billing and delivery address, telephone number and payment account information.

  • When you order: your name, contact details, delivery address, the items you bought and your chosen size and finish.
  • When you enquire: whatever you include in an email, chat message, phone call or form, so we can answer you.
  • When you send us a photo: the photo you upload for a custom portrait, a "see it on your wall" preview or a print of your own image. We use it only to produce that painting, print or preview.
  • When you browse: technical information such as the pages you visit, your device and browser type and your approximate location, collected through cookies and analytics tools described in section 5.
  • When you review us: the name and review text you choose to publish.

3.How we use it

We use this information to verify your identity, create your account, process and bill for your orders, send invoices and receipts, and correspond with you, such as replies to your enquiries, progress updates on your painting, delivery notifications and, if you have opted in, email newsletters.

We also use it to improve the site, to understand which artworks and pages people find useful, and to show relevant advertising to people who have visited us, as described in section 5.

4.Payments

At the time of payment, your card information is passed securely to our payment provider using encryption. We never store your card information. Payments are processed by trusted providers such as Shopify Payments, PayPal and Afterpay, each of which handles your payment details under its own privacy policy.

5.Cookies and analytics

A cookie is a small file stored on your computer by your browser. We use cookies to remember your preferences, keep items in your cart, personalise the content you see and measure how the site is used. Most browsers accept cookies automatically, but you can change your browser settings to decline them, though this may prevent you from taking full advantage of the site.

We use analytics and advertising tools such as Google Analytics and Meta (Facebook and Instagram) advertising tools. These collect information about your visit, such as pages viewed and actions taken, and may set their own cookies. They help us understand what works and let us show our artworks to people who have shown an interest in them. You can opt out of personalised advertising through your Google and Meta account settings.

6.Marketing emails

We only send newsletters and offers to people who have subscribed or bought from us. All email newsletters contain instructions to unsubscribe. You can also email info@directartaustralia.com.au to be removed from our mailing list at any time. Order and delivery emails are not marketing and are sent to everyone who buys.

7.Who we share it with

We will never sell or share your personal information except where required by law or where it is needed to fulfil your order and run the site. That means a limited set of partners:

  • Our online store platform (Shopify), which hosts the site and stores order records securely.
  • Payment providers, as described in section 4.
  • Delivery partners, who receive your name, address and phone number so they can deliver and, where needed, contact you about delivery.
  • Our artists and framers, who receive only what they need to make your artwork, such as the photo for a portrait and the size and finish ordered.
  • Email, review, chat and analytics services that we use to communicate with you and understand the site, each bound by its own privacy terms.

Some of these providers store information on servers outside Australia. Where that happens we take reasonable steps to ensure the information is handled in a way consistent with Australian privacy law.

8.Security

We have put in place suitable physical, electronic and managerial procedures to help prevent unauthorised access, modification, disclosure or loss of your personal information. The site is served over an encrypted connection, access to order records is limited to staff who need it, and card details are never held by us.

9.How long we keep it

We keep order records for as long as we need them to honour our guarantee, handle any returns and meet Australian record-keeping requirements for business and tax purposes. Photos sent for a portrait, print or preview are kept while the job is in progress and for a reasonable period afterwards in case a reprint or correction is needed, then removed. Enquiries that do not lead to an order are kept only as long as needed to answer them.

10.Your rights

We make every effort to give you access to your personal information so you can correct inaccuracies or request removal, provided it is not required for genuine business purposes or by law to be retained. You can ask us to:

  • tell you what personal information we hold about you;
  • correct anything that is wrong or out of date;
  • delete information we no longer need;
  • stop sending you marketing.

To request access, correction or removal, please contact info@directartaustralia.com.au. We aim to respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

11.Children

Our site is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will remove it.

12.Changes to this policy

Occasionally we may update this Privacy Policy. When we do, we will post the updated version here with a new "last updated" date, and changes take effect from the date they are posted.

13.Contact us

If you have questions or comments about this policy or how we handle your information, we are happy to help.
